Scott Wolf’s estranged wife, Kelley, has been charged with a misdemeanor.
According to a Statement of Probable Cause obtained by People on Friday, the “Party of Five” alum accused Kelley — the mother of his three children — of violating the Aug. 28 protective order on Aug. 30 by “using a friend’s phone and attempting to contact her son through a friend’s son.”
The alleged attempt to contact her son came two days after she was barred from having any contact with Scott or their sons Jackson, 16, and Miller, and daughter Lucy, 11. She was also ordered to stay at least 300 feet away from her estranged spouse.
Per the docs, a summons was also filed for the “Real World: New Orleans” alum, 48, to appear before a judge on Nov. 7.
In a statement to the outlet, Kelley said she was “utterly shocked” at what she called “the unabating aggressive use of a legal system and possibly more.”
She continued, “[It] has become almost intolerable to my physical body, my family’s health and well-being period. I’m unclear as to how these things are allowed to be processed. I have [allegedly] been compliant with everything legal, I have said nothing disparaging about anyone at any time.”
“I’d like to also state for anyone who doesn’t seem to understand — that divorce can take time,” Kelley added. “Anyone who continues to put pressure on a mother when all she’s doing is fighting for her children is somebody who needs to check themselves.”
Reps for Scott and Kelley did not immediately respond to Page Six’s requests for comment on the latest development in their case.
Scott — who filed for divorce from Kelley on June 10 after 21 years of marriage — last faced off against her on Sept. 10 over his request for a full restraining order. According to Us Weekly, the judge declined to rule on the matter due to Kelley’s lack of legal counsel.
The judge ordered that Kelley obtain a lawyer and then have her counsel “send the court a letter indicating that they are representing” her, after which Scott “will be directed by the court to send money directly to that attorney” to pay for a retainer.
The judge reportedly added that some terms of the previous temporary protective order — which he filed after Kelley was arrested for leaking his phone number via Instagram — will “remain the same.”
However, per a source for People, the former spouses can now correspond via phone for the sake of their children — though the insider claimed neither party is “required” to reply to communication attempts. The next hearing date is reportedly Oct. 26, by which time the mom of three must have retained legal representation.
Kelley previously checked into a rehab center and subsequently checked out on Tuesday after only two days in the facility, after telling a judge on Sept. 2 that she was “looking forward” to entering rehab. In comments to Page Six, Kelley confirmed she left the facility earlier this week, and divulged she was staying in a hotel in Arizona before entering a separate facility in November.
She also told us she does not need help for addiction issues, but rather for post-traumatic stress disorder (PTSD.)
The “Nancy Drew” actor was granted temporary sole custody of their children after Kelley was arrested and then charged with two counts of misdemeanor electronic disclosure of personal identifying information and one count of misdemeanor electronic communications harassment.
She was ordered to abstain from “any alcohol or narcotic drug or other controlled substance unless prescribed by a licensed medical practitioner” and barred from contacting potential witnesses in the ongoing case.
Kelley’s brief incarceration followed a string of publicly available social media posts, which included a screenshot of Scott’s personal phone number and alleged private texts with one of her children. As she was being arrested, she shared via Instagram Stories that she was “confused” and denied wrongdoing.
The TV stars married in 2004. Following their June split, Kelley was placed on two involuntary holds. Prior to her first, she live streamed herself being detained by law enforcement via Instagram. “I think Scott Wolf is abusing me, and now you are abusing me more,” she said at the time, though it was unclear what she meant by “abusing.”
The couple’s drama has also included a live streamed attempt by Kelley to gain access to personal items in their Park City, Utah, home, and an accusation by Scott that she is conspiring to make “disturbing false” claims against him.
Scott initially filed for a restraining order in July, but later dropped the matter.
